يستكمل قاضي التحقيق الأول في بيروت، بلال حلاوي، يوم الخميس، استجواب حاكم مصرف لبنان السابق، رياض سلامة، في ادعاء النيابة العامة المالية ضدّه بجرم «اختلاس أموال عامة وتبييض الأموال والإثراء غير المشروع»، على أن يجري مواجهة بينه وبين وكيل البنك المركزي المحامي ميشال تويني.
وأكد مصدر قضائي لـ«الشرق الأوسط» أن جلسة الخميس «ستحدد مصير سلامة، سواء لجهة الاستمرار في توقيفه أو إتاحة المجال أمام تقديم طلب لإخلاء سبيله». وأشار إلى أن قاضي التحقيق «غير مستعجل باتخاذ قراره قبل أن تتوفر لديه كل المعطيات المتعلقة بالقضية».
ورأى المصدر أنه «بغض النظر عمّا إذا كان وكيل سلامة المحامي مارك حبقة سيتقدّم بطلب لإخلاء سبيله أم لا، فإن التحقيق لا يزال بحاجة إلى إجراءات لا بد من استكمالها، إن لجهة الاستماع إلى الشهود أو الاستحصال على مزيد من المستندات المتعلّقة بالتحويلات الخاصة بمبلغ الـ42 مليون دولار الخاصة بحسابات الاستشارات أو بقانونية هذه التحويلات».
خمسة شهود
واستمع القاضي حلاوي، الثلاثاء، إلى إفادات خمسة شهود، هم المحامي مروان عيسى الخوري (وكيل الشركات الاستشارية وابن شقيقة رياض سلامة)، ومدير دائرة القطع والعمليات الخارجية في البنك المركزي نعمان ندّور، ومدير الشؤون القانونية في المصرف بيار كنعان، وأمينة سرّ المجلس المركزي في مصرف لبنان ماجدة المشنوق، وعضو المجلس المركزي عبد الحفيظ منصور.
وأوضحت مصادر مواكبة للتحقيق أن «إفادات هؤلاء الشهود تمحورت حول التحويلات وحركة الأموال التي تنقلت من حساب البنك المركزي ومنها إلى حساب ميشال تويني ثمّ مروان عيسى الخوري، قبل أن تعود إلى حساب الحاكم كما ورد في تقرير هيئة التحقيق الخاصة».
مقاضاة غادة عون
وبمواجهة محاولات المدعية العامة في جبل لبنان، القاضية غادة عون، الدخول على الملفّ مجدداً، يتجه رياض سلامة إلى مقاضاتها ردّاً على «التجاوزات» التي ترتكبها بحقّه. وكشف وكيل سلامة المحامي مارك حبقة لـ«الشرق الأوسط» عن أنه «سيتقدّم الأربعاء بدعوى أمام النيابة العامة التمييزية يتخذ فيها صفة الادعاء الشخصي ضدّ القاضية عون وكلّ من يظهره التحقيق بجرائم اغتصاب السلطة وخرق سرّية التحقيق والتعدي على صلاحيات مرجع قضائي آخر (قاضي التحقيق الأول في بيروت)، وتجاوز حدود السلطة المعطاة لها»، مشيراً إلى أن الدعوى «تأتي على خلفية قرار القاضي عون استدعاء الحاكم السابق إلى جلسة تحقيق حددتها يوم الأربعاء الماضي، وهو أمر يتعارض مع القانون، إذ لا يحقّ لأي مرجع قضائي أن يحقق بقضية مفتوحة أمام مرجع قضائي آخر».
عملية خداع!
وعلمت «الشرق الأوسط» أن وكيل مصرف لبنان، المحامي ميشال تويني، مثل يوم الخميس الماضي أمام القاضية عون، وقالت مصادر قريبة من تويني إنه «تعرض لعملية خداع تشبه الاختطاف على يد محامٍ مقرّب جداً من القاضية عون، إذ وفور انتهاء جلسة استماعه أمام القاضي حلاوي اصطحبه المحامي المذكور إلى مكتب عون في قصر العدل في جبل لبنان، وتبيّن أنها فتحت محضراً لاستجوابه، إلا أن تويني امتنع عن الإدلاء بأي إفادة لأنه غير مهيّأ لها ويعاني من إرهاق بعد الجلسة التي خضع لها أمام حلاوي، فما كان من الأخيرة إلّا أن حددت له جلسة لاستجوابه، الثلاثاء، وطلبت منه التوقيع على المحضر كأنه بُلِّغ رسمياً موعد الجلسة، إلّا أن تويني امتنع عن المثول أمامها، خصوصاً أنها ذكرت أمامه أنها بصدد الادعاء عليه وملاحقته قبل قاضي التحقيق في بيروت».
ويعقد مجلس نقابة المحامين في بيروت جلسة، الأربعاء، للنظر بطلبي القضاء إعطاء الإذن لملاحقة المحاميين تويني وعيسى الخوري، وتردد أن النقابة تتجه للسماح للقضاء بملاحقتهما، باعتبار أن الشبهات المزعوم ارتكابها من قبلهما ودورهما بالتحويلات المالية لم تحصل بمعرض ممارستهما للمهنة.
إلى ذلك، أعلن رئيس الهيئة الاتهامية في بيروت، القاضي ماهر شعيتو، تنحيه عن النظر في استئناف هيئة القضايا في وزارة العدل قرار قاضي التحقيق بعدم قبول ضمّ الدعوى التي تقدمت بها الهيئة ضدّ رياض سلامة. وأشار مصدر قضائي إلى أن شعيتو اتخذ قرار التنحي «لكون سلامة رفع دعوى مخاصمة ضدّه في القضية السابقة». وأحيل القرار إلى الرئيس الأول لمحكمة الاستئناف في بيروت القاضي حبيب رزق الله لتعيين هيئة اتهامية جديدة للنظر في استئناف هيئة القضايا.

Thursday Session to Determine Salameh’s Fate as Five Witnesses Provide Testimonies
On Thursday, Judge Bitar Halawi, the First Investigating Judge in Beirut, will continue the interrogation of former Central Bank Governor Riad Salameh. This follows the financial prosecutor's charges against him for “embezzlement of public funds, money laundering, and illicit enrichment.” The session will also involve a confrontation between Salameh and Michel Toueni, the legal representative of the Central Bank.
A judicial source informed Asharq Al-Awsat that the Thursday session “will determine Salameh's future, whether in terms of continuing his detention or considering a request for his release.” The source highlighted that Judge Halawi “is not in a hurry to make a decision until all the relevant evidence in the case is gathered.”
The source added that “regardless of whether Salameh's lawyer, Marc Habeqa, submits a request for his release or not, the investigation requires further steps, including hearing from more witnesses and obtaining additional documents concerning the $42 million consultancy account transfers or the legality of these transactions.”
Five Witnesses
On Tuesday, Judge Halawi heard the testimonies of five witnesses, including lawyer Marwan Issa El Khoury (Riad Salameh’s nephew and representative of the consultancy firms), Naaman Naddour (Head of the Foreign Operations Department at the Central Bank), Pierre Kanaan (Legal Affairs Director at the Central Bank), Majda Mashnouq (Secretary of the Central Council of the Central Bank), and Abdul Hafiz Mansour (a member of the Central Council).
Sources close to the investigation revealed that the testimonies focused on the transfer of funds and how money moved from the Central Bank to Michel Toueni, then to Marwan Issa El Khoury, and finally back to Salameh’s account, as detailed in the Special Investigation Commission's report.
Salameh to Sue Ghada Aoun
Meanwhile, amid attempts by Mount Lebanon’s Attorney General, Judge Ghada Aoun, to reopen the case, Riad Salameh is preparing to file a lawsuit against her in response to the “violations” she allegedly committed against him. Marc Habeqa, Salameh’s lawyer, told Asharq Al-Awsat that on Wednesday, he would file a lawsuit with the General Prosecutor’s Office, personally accusing Judge Aoun and anyone else involved of “abuse of power, breaching the confidentiality of the investigation, overstepping the authority of another judicial official (the First Investigating Judge in Beirut), and exceeding the limits of her powers.” This lawsuit is based on Judge Aoun summoning Salameh for questioning last Wednesday, which, according to Habeqa, contradicts the law as no judicial body can investigate a case that is already open before another judicial authority.
Deception Claims
Asharq Al-Awsat learned that Michel Toueni, the Central Bank’s representative, appeared before Judge Aoun last Thursday. Sources close to Toueni stated that he was subjected to “deception, almost like being kidnapped” by a lawyer closely associated with Judge Aoun. After Toueni’s hearing with Judge Halawi, the lawyer allegedly led him to Judge Aoun’s office in the Mount Lebanon Justice Palace, where she attempted to question him. Toueni declined to provide any testimony, citing fatigue from his earlier session with Judge Halawi. Judge Aoun then scheduled another session for him on Tuesday, asking him to sign a document confirming the appointment, but Toueni refused to attend, particularly after she mentioned her intent to charge him before the Beirut Investigating Judge.
The Beirut Bar Association will hold a session on Wednesday to review requests from the judiciary for permission to prosecute Toueni and Issa El Khoury. It is expected that the Bar Association will grant permission, as the alleged offenses related to the financial transfers were not committed in the course of their legal practice.
Additionally, Judge Maher Shaaito, the head of the Beirut Indictment Commission, recused himself from reviewing the appeal submitted by the Ministry of Justice’s Legal Affairs Department regarding the Investigating Judge’s decision not to accept the Ministry’s lawsuit against Salameh. A judicial source confirmed that Shaaito’s decision to withdraw stems from Salameh filing a compensation lawsuit against him in a previous case. The decision will now be referred to the President of the Beirut Court of Appeals, Judge Habib Rizkallah, who will appoint a new panel to review the Legal Affairs Department’s appeal.
